In the Name of God Amen I John Marland of Twarlehill Within the parish of
Ashton Underline in the county of Lancaster Yeoman being Old and Infirm in Body but of Sound and perfect mind and Memory (praised be God for the Same) Yet Calling to mind the Uncertain State of This transitory Life And being Desirous to Settle my Worldly Affairs before my Death To the Intent there may be no difference about the same Do make and Ordain this my Last Will and Testament in Manner and Form following Hereby Dissannulling and Utterly revoking all form or wills and Testaments by me in any wise heretofore made (that is to say) First my Will and mind is that all my Funeral Expences and Charges of the probate of this my last Will and Testament be paid out at my personal Estate And Whereas by one Indenture of Assignment bearing Date the Fifth day of January Anno Domini One Thousand Seven Hundred and Thirty One, I Did Demise & Grant Assign and set over unto Obadiah Marland of Hartshead my Nephew his Executors Administrators and Assigns All that parcel of Ground Called Brown Edge Together with the Privilidge of Getting and Selling the White Stone on Brown Edge aforesaid or any other delf within the parish of Ashton Underline aforesaid For and during the Term of Twenty One Years to Commence the Day next after my Decease, He the said Obadiah Marland paying the yearly rent of Five pounds to such person or persons As I by my last Will and Testament shall Limmit direct and Appoint to receive the Same As by the said Assignment relation therunto being made may Appear It is my Will and mind and I do hereby Give Leave and bequeath the the [sic] said Yearly rent of Five pounds unto James and Obadiah Marland Ann wife of James Winterbotham Betty wife of Robert Wyld Sarah Martha and Mary Sons and Daughters of my Nephew Obadiah Marland, during the said Term of Twenty one Years to be Equally Divided Amongst them share and Share Alike or to so many of them as shall happen to live And from and after the end and Expiration of the said One and Twenty Years Then I Give and Devise the Said parcel of Ground called Brown Edge with its Appurtenances unto to my brother James Marland his Heirs and Assigns during all the Term Estate and Interest as shall be then to Come and Unexpired to the Original Lease with the Leave and tenantright expectant Also I Give unto my Brother James Marland to my Niece Susannah wife of Henry France and Martha wife of John Chadderton Each Two shillings And do hereby Order the Same in full of all their Claim to all my real and personal Estate whatsoever (Except as above) Also I Give and bequeath unto James son of John Davenport a pair of Looms Also I give my Brother Jacob all Such Sum and Sums of money as are or shall or may be due to me upon any Account whatsoever Also I Give and Bequeath unto Alice Davenport and Mary Hill the Sum of Five Shillings Each if my personal Estate besides My Lawful Debts being paid will amount to it I devise my Two Seats in Ashton Church to Obadiah Marland and his Heirs for ever And of this my Last Will I do Constitute and make the said Obadiah Marland Elder and my Loving Friend John Buckley of Ashton Underline Inholder Executors hoping they will perform the Same According to the Trust I have reposed in them. In Witness whereof I the said John Marland the Testator have hereunto put my Hand and Seal this Eleventh day of March In the year of our Lord One Thousand Seven Hundred and Thirty Five |
