1. Charter of Alan de Merland made for Roger constable of Chester, for
Merland. Let all persons as much present as future know that I Alan de Merland have sold and conceded and by this my present charter confirmed to Roger constable of Chester all my land of Merland in fee and inheritance for ever, just as I at one time had or held it better and more freely and more peacefully, for one hundred silver shillings which he has given me for all that belongs to me. The said Roger de Lascy and his heirs will also hold for themselves the said land freely and with immunity with all appurtenances, in woods, in open land, in roads, in paths, in meadows, in grazing and pastures, in waters, in mills, in ponds, in fishponds, and in all places and easements which are there or could be made. To pay annually to my lord Hugh de Eland and his heirs of eleven silver pence on the feast of St Martin, excepting the King's service abroad and the service of Hugh de Eland for the said adjacent land. And I Alan and my heirs will guarantee the said land of Merland to the said lord Roger and his heirs or whomsoever he wishes to give it to against all men, and having touched the holy [evangelists] I have sworn, that I shall not seek ways or means whence the said Roger and his heirs or to whoever he has given the said land to may lose it. And so that this sale be firm and unquestioned I have confirmed it with my affixed seal. With these witnesses: lord Ranulph Earl of Chester, Philip de Orreby justiciar of Chester, Hugh and Geoffrey Dutton, Hugh and Thomas Dispenser, Michael bailiff of the lord of Rochdale, Adam de Spotland, and many others who have seen or heard this. |

Lancashire and Cheshire Wills
Ecclesiasical Court Chester The Will of Henry Hamer of Hamer, Yeoman 18 January 1572/73; proved May 12th, 1573. It may be assumed that the testator was a very aged man at his death, as in a letter to the Chancellor, dated Rochdale 1573, the Rev. Richard Midgley, the Vicar, stated that "Alice Hamer of Hamer the relict was unable to travel to the Court at Chester to prove the will, being of the great age of 88 years and encompassed with sondrie infirmities," and therefore the will was sent by her "lovinge friends" James Halliwell of Ealees and James Marland of Marland [Lanc. MSS].
